1. These Rules establish the procedure for issuing a document confirming the carrying out of basic work on the construction of an individual housing construction project (installation of the foundation, erection of walls and roofing) or carrying out work on the reconstruction of an individual housing construction project, as a result of which the total area of the residential premises (living premises) being reconstructed of the object increases by no less than the accounting standard for the area of residential premises established in accordance with the housing legislation of the Russian Federation. Such a document is an act of inspection of the main construction (reconstruction) work of an individual housing construction project (hereinafter referred to as the inspection act).

2. The inspection report is issued by the body authorized to issue a construction permit (hereinafter referred to as the authorized body), based on the application of the person who received the state certificate for maternity (family) capital, or his representative. The application may be accompanied by a document confirming the fact of the creation of an individual housing construction project (cadastral passport of a building, structure, unfinished construction project or cadastral extract of a real estate property).

3. The authorized body organizes, in the manner established by it, an inspection of an individual housing construction project in the presence of a person who has received a state certificate for maternity (family) capital, or his representative. During the inspection, measurements and examinations of the inspected object may be carried out.

Based on the results of the inspection of an individual housing construction project, an inspection report is drawn up in the form approved by the Ministry of Construction and Housing and Communal Services of the Russian Federation.

4. The inspection report is issued by the authorized body to the person who received the state certificate for maternity (family) capital, or to his representative personally against signature, or sent by registered mail with notification within 10 working days from the date of receipt of the application specified in paragraph 2 of these Rules.

5. The authorized body refuses to issue an inspection report if:

during the inspection of the main work on the construction of an individual housing construction project (installation of the foundation, construction of walls and roofing), it will be established that such work has not been completed in full;

during the inspection of the reconstruction of an individual housing construction project, it will be established that as a result of such work, the total area of the residential premises does not increase or increases by less than the accounting standard for the area of residential premises established in accordance with the housing legislation of the Russian Federation.

6. The decision to refuse to issue an inspection report is brought by the authorized body to the attention of the person who received the state certificate for maternity (family) capital, or his representative in the manner and within the period provided for in paragraph 4 of these Rules.

The decision to refuse to issue an inspection certificate may be appealed in court.

7. A person who has received a state certificate for maternity (family) capital, or his representative, has the right to re-submit an application for the issuance of an inspection certificate after eliminating the circumstances that caused the refusal to issue an inspection certificate.

Maternity (family) capital funds can be used, in particular, for the construction (reconstruction) of an individual residential building.

The relevant work can be carried out either with the assistance of construction organization, and by citizens.

In the latter case, up to 50% of maternal (family) capital can be obtained before the start of work, the rest - after installing the foundation, erecting walls and roofing (during construction) or increasing the total area of housing by no less than the accounting norm (during reconstruction).

The construction (reconstruction) work is confirmed by an inspection report.

It is issued by the authority that issues building permits. To do this, the person who received the state certificate for maternity (family) capital, or his representative, must submit an application.

The application can be accompanied by a document confirming the fact of the creation of a residential building (cadastral passport of a building, structure, unfinished construction project or cadastral extract of a real estate property).

The authorized body inspects the residential property in the presence of the applicant. At the same time, he can carry out measurements and examinations.

The inspection report is drawn up based on the results of the inspection and is issued within 10 working days from the date of submission of the application.

The decision to refuse to issue an inspection certificate can be appealed in court.

It is allowed to re-submit an application for an inspection certificate after eliminating the reasons for refusal to issue it.
